DRA Machine Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the DRA Machine mobile application (the "App"), developed and operated by Bile Beans For Biliousness Pty Ltd ("we", "us", or "our"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

These Terms of Service are available at any time at bilebeans.com/terms-of-service.

2. Eligibility

You must be at least 16 years of age (or the applicable age of consent in your jurisdiction, whichever is higher) to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under the age of 18, you must have the consent of a parent or legal guardian to use the App. The App is not directed at children under 16 and we do not knowingly allow them to create accounts.

3. Account Registration

To access certain features of the App, you may be required to create an account through Google Firebase Authentication. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate your account at our sole discretion, including but not limited to cases of suspected fraud, violation of these Terms, or as described in Section 7 (Purchases and Payments).

4. Description of the App

DRA Machine is an AI-based roleplay game. The App uses artificial intelligence to generate interactive narrative experiences. Content generated by the AI is procedural and may vary between sessions. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content.

5. User Conduct

You agree not to use the App to:

  • Violate any applicable law, regulation, or third-party rights
  • Distribute, upload, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Attempt to gain unauthorised access to the App, its servers, or any related systems or networks
  • Interfere with or disrupt the App or the servers and networks connected to the App
  • Use any automated means (including bots, scrapers, or crawlers) to access the App or collect data from it
  • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
  • Exploit the App for any commercial purpose not expressly authorised by us
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
  • Attempt to manipulate, exploit, or abuse the AI system in any way that could cause harm to other users, the service, or third parties

5.1 Prohibited Content and AI Misuse

You are solely responsible for the prompts, messages, and other content you submit to the App. You agree not to submit content, nor attempt to use the AI to generate or facilitate the generation of content, that:

  • Sexually exploits or abuses children in any form, including child sexual abuse material (CSAM) or content that sexualises minors
  • Depicts non-consensual sexual acts, sexual violence, or sexual content involving identifiable real people without their consent
  • Constitutes a deepfake, impersonation, or other deceptive synthetic media of a real, identifiable person (including public figures) without clear satirical or educational context and their consent where legally required
  • Provides instructions, recipes, or operational guidance for building weapons, explosives, poisons, or biological, chemical, radiological, or nuclear agents
  • Promotes, glorifies, or provides methods for self-harm, suicide, or eating disorders
  • Incites violence against, threatens, or harasses any individual or group based on race, ethnicity, religion, nationality, disability, gender, sexual orientation, gender identity, or any other protected characteristic
  • Promotes terrorism, violent extremism, or organised criminal activity
  • Is designed to facilitate fraud, scams, malware distribution, phishing, or other deceptive or harmful commercial practices
  • Infringes the intellectual property rights, publicity rights, or privacy rights of any third party
  • Contains personal or identifying information of another person without their consent

We reserve the right, at our sole discretion and without prior notice, to remove content, refuse service, warn, suspend, or permanently terminate the account of any user who submits content in violation of this section or otherwise violates these Terms. We may also report violations to law enforcement where required by law.

6. User Content and Data

By using the App, you acknowledge and agree that your in-game interactions and content may be collected and used in accordance with our Privacy Policy, available at bilebeans.com/privacy-policy.

AI Training: Your in-game data may be used to train and improve our AI models. This data is collected and used in a completely anonymous manner. No personally identifiable information is associated with AI training data unless you choose to share your data, in which case it may be associated with your game ID.

You retain ownership of any original content you create within the App. However, by submitting content through the App, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, modify, adapt, and create derivative works from such content for the purposes of operating, improving, and promoting the App, including AI training.

7. Purchases and Payments

The App may offer in-app purchases. All purchases are processed through the applicable app store (Apple App Store or Google Play Store) and are subject to the terms and conditions of that platform.

We collect transaction data, including records of in-app purchases, to assist with account management, purchase verification, and customer support. We also collect device model information to assist with account-related inquiries.

7.1 Refunds

Refund requests are subject to the refund policies of the applicable app store. We do not process refunds directly.

7.2 Credit Card Chargebacks

If you initiate a credit card chargeback in relation to any purchase made within the App, your account will be permanently banned. We reserve the right to take this action immediately upon notification of a chargeback. If you believe a transaction was made in error, we encourage you to contact us or the applicable app store to resolve the issue before initiating a chargeback.

8. Advertisements

The App displays advertisements served by Google AdMob. By using the App, you acknowledge and agree that advertisements will be displayed during your use of the App. Advertisements may be personalised based on your interests and usage data, as described in our Privacy Policy.

You may opt out of personalised advertising through your device settings. Opting out will not remove advertisements from the App but may result in less relevant ads being shown.

9. Intellectual Property

The App and its entire contents, features, and functionality (including but not limited to all text, graphics, images, audio, video, software, code, and design) are owned by Bile Beans For Biliousness Pty Ltd or its licensors and are protected by Australian and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial use, subject to these Terms.

10. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. AI-generated content is provided for entertainment purposes only and should not be relied upon for any factual, medical, legal, financial, or professional advice.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BILE BEANS FOR BILIOUSNESS PTY LTD, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP.

Where liability cannot be excluded under Australian Consumer Law, our total liability to you for all claims arising out of or relating to the use of the App is limited to the amount you have paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Bile Beans For Biliousness Pty Ltd and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Victoria, Australia, for the resolution of any disputes arising out of or relating to these Terms or the App.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by us in the App, constitute the entire agreement between you and Bile Beans For Biliousness Pty Ltd regarding your use of the App.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms within the App or at bilebeans.com/terms-of-service. Your continued use of the App following the posting of changes constitutes your acceptance of such changes.
